Terms of Use

Effective September 24, 2026.

These Terms of Use govern your access to absorb.dev and its pages, forms, and emails (the "Site"), operated by Absorb.dev LLC ("Absorb", "we", "us"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Scope

The Site provides information about Absorb software and lets you contact us about evaluations and purchases. Use of Absorb software is governed by the Master Software License and Services Agreement and the applicable Order Form, not by these Terms. Online purchases are also governed by the Online Subscription Terms. If these Terms conflict with a signed agreement, the signed agreement controls.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. If you use the Site for an organization, you confirm you are authorized to accept these Terms on its behalf, and "you" includes that organization.

3. Inquiries and evaluations

  1. Contacting us, booking a demo, or requesting an evaluation does not create a license, reservation, or right to purchase.
  2. We decide whether to offer an evaluation, when, and on what terms.
  3. Evaluations are provided only under the evaluation terms of the Master Software License and Services Agreement or other written terms we issue.

4. Acceptable use

You will not:

  1. Access or attempt to access nonpublic areas of the Site or our systems.
  2. Probe, scan, or test vulnerabilities, except as permitted in Section 5.
  3. Interfere with the Site, including by overloading forms, bypassing rate limits, or automating form submissions.
  4. Submit false information or another person's contact details through Site forms.
  5. Scrape or harvest Site content or data, other than ordinary search engine indexing.
  6. Upload malware or unlawful, infringing, or deceptive content.
  7. Misrepresent your identity or any affiliation with Absorb.

5. Security research

We welcome good-faith security reports under the disclosure policy published at absorb.dev/.well-known/security.txt. We will not pursue legal claims against research that follows that policy, avoids privacy violations, data destruction, and service degradation, and is reported to us promptly. This safe harbor does not cover third-party systems.

6. Intellectual property

The Site, its content, and the Absorb name, logos, and product names belong to Absorb or its licensors. We grant you a limited, revocable, non-transferable permission to view and print Site content to evaluate Absorb. No other right is granted, and you may not use our marks without written permission.

7. Feedback

If you send us ideas or suggestions, we may use them without restriction or obligation to you.

The Site refers to third-party products and standards, such as OpenAPI, MCP, Kong, Apigee, MuleSoft, Claude, and Cursor. Those names belong to their owners, and their mention does not imply endorsement, partnership, or affiliation. We are not responsible for third-party sites we link to.

9. Site information

Site content, including comparisons, pricing, performance figures, and release plans, is general information that may change without notice. It is not an offer or a commitment. Prices and product commitments are binding only when stated in a signed Order Form.

10. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ABSORB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA, ARISING FROM THE SITE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED US$100.

12. Indemnity

You will defend and indemnify Absorb against third-party claims arising from your breach of these Terms or misuse of the Site, including reasonable attorneys' fees.

13. Privacy

Our Privacy Policy explains how we handle personal data collected through the Site.

14. Changes and termination

We may update these Terms by posting a new version with a new effective date. Continued use after that date means you accept the update. We may suspend or end your access to the Site at any time for breach of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, excluding its conflict of laws rules. The state and federal courts located in Delaware have exclusive jurisdiction, and each party consents to them. Nothing in this section removes mandatory consumer protections available where you live.

16. General

These Terms are the entire agreement between you and Absorb about the Site. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor.
